Introduction

Oil ALBERA, S.L. has a whistleblowing channel so that those aware of serious infringements or crimes committed during the course of their activity or relationship with the company may report them. The channel is the communication instrument that forms part of the organisation’s internal information system.

Who can report through the whistleblowing channel

Company employees, former employees, volunteers, interns, workers undergoing training periods, candidates, self-employed workers, partners, personnel from contracting companies, subcontractors and suppliers, legal representatives of employees or individuals advising the whistleblower, natural persons related to the whistleblower who may suffer retaliation, such as co-workers or family members of the whistleblower, as well as legal entities for which the whistleblower works or with which they maintain any other type of relationship in a work-related context or in which they hold a significant participation.

What can be reported

  • Actions or omissions that may constitute infringements of European Union law.
  • Actions or omissions that may constitute a serious or very serious criminal or administrative offence.
  • Violations of labour law regarding occupational health and safety.

This channel is not intended for communicating labour or commercial complaints between parties.

The channel must be used in good faith. If the complainant acts knowing that the information provided is false, or with the sole purpose of discrediting the reported person or institution, the corresponding liabilities may be enforced.

Confidentiality and non-retaliation

This system guarantees the confidentiality of the complainant and any third party mentioned in the communication, both legally and technically, and allows anonymity.

Likewise, the system is subject to the principle of non-retaliation for complainants and third parties. When the organisation becomes aware that the complainant or whistleblower has been subjected to intimidation or retaliation, it will promote or carry out appropriate corrective or restorative actions.

Anonymous complaints

Complaints may be submitted anonymously; the most important factor is the plausibility of the facts presented, not the identity of the complainant. However, anonymity makes it more difficult to maintain an open communication channel with the complainant, which facilitates the analysis and investigation process. Likewise, depending on the type of reported infringement (especially if it directly affects the complainant), anonymity may also significantly hinder the investigation.

Processing of the complaint

Submitting the report automatically generates a receipt number available to the complainant. The complaint is forwarded to the company’s system manager, initiating the analysis and investigation phase.

The procedures will be carried out with the utmost discretion and confidentiality, in accordance with the law.

Within a maximum period of three months (extendable by an additional 3 months if the investigation is especially complex), the company will inform the complainant of the outcome of the resolution resulting from the complaint (provided that the complaint is not anonymous).

It is possible to maintain communication with the complainant or request additional information.

If the investigations reveal evidence of a crime, the facts will be referred to the Public Prosecutor’s Office or the judicial authority and, where appropriate, to the European Public Prosecutor’s Office.

The affected person will have the right to be informed of the actions or omissions attributed to them, always respecting their right to honour and the presumption of innocence.

Independent Whistleblower Protection Authority

We inform you that you may submit your report through the channel available on the website of the Oficina Antifrau de Catalunya if the infringement is limited to the Autonomous Community of Catalonia, or through the website of the Autoridad Independiente de Protección del Informante if the reported events took place outside this autonomous community.
